Competition Terms : “Tide’s Gift Guide”

1. The Promoter

  • The promoter is: Tide Platform Ltd (09595646), a company incorporated in England & Wales with its registered address at 5th Floor, 1 Appold Street, London, England, EC2A 2UT (the “Promoter”).

2. Our Channels

  • Our social media channels are:

    • Instagram @tidebanking;

    • LinkedIn: @tide-banking (the “Social Channels”); and
  • Our competition email is: social@tide.co (the “Email Address”).

3. These Terms

  • These are the Promoter’s general competition terms and conditions. The communication announcing the competition (the “Competition Announcement”) will be made via our Website, Social Channels or via email, or a combination of these, setting out:
  • What steps you need to take to enter the competition;
    • What prize will be awarded to winners;
    • Whether the competition is for new or existing members or both;
    • Where you can find these terms; and
    • In the case of a judged competition, the criteria the judges will use to determine the winners.
  • The Competition Announcement may also set out:
    • The Opening Date and Closing Date (defined below); and
    • The Announcement Date (defined below).
  • The Competition Announcement may make reference to further information being available on our Website or Social Channels. Further information may also be provided through our Website, Social Channels or via email. In such circumstances the further information shall form part of the Competition Announcement.
  • The Competition Announcement and these terms will form the complete set of terms and conditions for the competition.
  • In the case of conflict between the Competition Announcement and these terms, the Competition Announcement shall prevail.

4. How to Enter

  • The competition will run from the date and hour set out in the Competition Announcement (the “Opening Date”) to 23:59 GMT on the date set out in the Competition Announcement (the “Closing Date”) inclusive.
  • If the Opening Date is not set out in the Competition Announcement, the Opening Date shall be from the availability of the Competition Announcement. If the Closing Date is not set out in the Competition Announcement, then there shall be no Closing Date and the prize shall be subject to availability.
  • All competition entries must be received by the Promoter by no later than 23:59 GMT on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
  • To enter the competition, by the Closing Date, you must follow the instructions set out in the Competition Announcement.
  • No purchase is necessary and there is no charge to register for use of the Website.
  • The Promoter will not accept:
    • responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    • proof of posting or transmission as proof of receipt of entry to the competition.
  • By submitting a competition entry, you are agreeing to be bound by the terms and conditions.
  • In the case of a judged competition the decision of the judges (acting reasonably) will be final.
  • In the case of a judged competition the full names of the judges are available to anyone who contacts the Promoter via the Email Address within one month after the Closing Date or may be published via our Website.

5. Eligibility

  • The competition is only open to all residents in the UK aged 18 years or over, except:
    • employees of the Promoter or its holding or subsidiary companies;
    • employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration;
    • members of the immediate families or households of (a) and (b) above; and
    • Tide members that are featured in the Gift Guide
  • In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
  • The Promoter will not accept competition entries that are:
    • automatically generated by computer;
    • completed by third parties or in bulk;
    • illegible, have been altered, reconstructed, forged or tampered with;
    • photocopies and not originals
  • There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Multiple comments won’t be counted as an extra entry.
  • The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.
  • Competition entries cannot be returned.
  • The Promoter reserves its right to reject entries that are unlawful, indecent, racist, inflammatory, defamatory or which we otherwise consider harmful.

6. The Prize

  • The prize is set out in the Competition Announcement.
  • The prize is not negotiable or transferable.
  • The prize can only be awarded to a Tide account of which the competition entrant is the account holder in the case of a prize to be credited to a Tide account.
  • In the case you are new members (a person that has not been an account holder of a Tide account before participating in the competition), you must also complete an application to open a Tide account before the Closing Date and said application must be successful.
  • If the Competition Announcement does not state whether the competition is for new or existing members it shall be open for both in so far as possible.

7. Winners

  • Winners will be randomly selected (on a random draw principle) by the Promoter (or a third party on Promoter’s behalf).
  • Promoter reserves the right to conduct further verification of the winners (including identity), where so required by applicable laws or regulations, and withdraw entitlement to the award when required to do so or when the participant no longer fulfils the eligibility criteria. 
  • To receive the prize, a winner must provide all information requested by the Promoter as soon as reasonably possible before the end of day when they are contacted by the Promoter.
  • If the winner fails to pass the foregoing verification process or to provide the requested information as required, the Promoter will repeat this selection process until a winner fulfils the criteria above. 
  • The Promoter will contact the winner personally as soon as practicable after the Announcement Date, as set out in the Competition Announcement. The Promoter will not amend any contact information once the competition entry form has been submitted. In the case of a competition conducted via Instagram and Twitter the winner will be contacted through direct messages. If conducted via Facebook the winner will be contacted via the email address registered to the Tide account. In any event the winner may be contacted via the email address registered to the Tide account or contacted through the Tide platform.
  • If the Announcement Date is not stated in the Competition Announcement, then the Announcement Date shall be from time to time as long as the competition persists.
  • The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter may publish the surname and county of major prize winners and, if applicable, their winning entries in media such as the Promoter’s Website, Social Channels, emails or otherwise on the Announcement Date. In the case of the Promoter not publishing the winners, that information shall be available on request to anyone who contacts the Promoter via email the Email Address within one month after the Closing Date. The Promoter reserves its right to change the Announcement Date due to, but not limited to, delays or otherwise.
  • If you object to any or all of your surname, image, county and winning entry being published, whether through our Social Channels, Website or email, or made available, please contact the Promoter via the Email Address. If such information has already been published on our Social Channels or Website, we shall remove it in so far as reasonably possible. In such circumstances, the Promoter must still provide the information (save for your image) and winning entry to the Advertising Standards Authority on request.

8. Claiming the Prize

  • The prize shall be awarded instantly where possible once winners have been decided. Please allow 6 to 8 weeks for delivery of the prize after the Closing Date, or in the case of no Closing Date, from submission of your entry if you are a winner. In some cases the delivery of the prize may be delayed if for example you are in the process but have not yet fulfilled all the requirements of the prize.
  • The prize may not be claimed by a third party on your behalf.
  • The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 14 of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date. It is the responsibility of the entrant to provide correct, up-to-date details when entering the competition and accepting of the prize.  The Promoter shall not be held responsible for winners failing to supply accurate information which affects prize announcement, acceptance or delivery of their prize
  • The Promoter does not accept any responsibility if you are not able to take up the prize.

9. Limitation of Liability

  • Insofar as is permitted by law, the Promoter, its agents, officers, employees, contractors or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

10. Data Protection and Publicity

  • The Promoter will only process entrants’ personal information as set out in The Promoter’s Privacy Policy at https://www.tide.co/privacy/ , as well as, if applicable, for the purposes of administering this competition.  You acknowledge that the Promoter may pass such personal information to any relevant third-party partners, solely for the purposes of administering the competition (including announcing the winners). (See Clause 7 with regard to the announcement of winners.)
  • The winner agrees to the use of his/her name and image, such as photographs, in any publicity material, as well as their entry, such as being referred to on our Website or reasonably tagged via our Social Channels in relation to the competition, subject to Clause 5. Any personal data relating to the winner or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
  • The Promoter does not conduct this competition in association, sponsorship or partnership with other entities unless otherwise stated in the Competition Announcement.

11. General

  •  Tide reserves the right to verify whether you were eligible to participate in the competition and validly participated, and disqualify you if the conditions were not respected.
  •  If there is any reason to believe that there has been a breach of these terms and conditions or breach of the Tide Platform terms and conditions where applicable, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition or disentitle you from or forfeit any award won.
  • The Promoter reserves the right to hold void, suspend, cancel, or amend the competition or these terms where it becomes necessary to do so.
  • These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions or its subject matter or formation.
