RELEASE TERMS

This document lays down the terms on which I allow Tide Platform Private Limited, a company having its address at Level 13, Plot No. 19, Software Unit Layout, Madhapur Hyderabad, Telangana – 500081 (“Tide”) and its affiliates to use my Submission (defined below).

1. I grant Tide, its assignees and successors, perpetual, worldwide, royalty-free permission to record, copy, publish, modify, exhibit, distribute or otherwise use all elements of my submission including its text, my name, image, likeness, and/or voice and the name and images relating to my business, its products, logos and other trademarks (collectively my “Submission”) in any media (including image, video/audio, and print) in any medium of release (including mass media, traditional media, and digital media) [together “Permitted Channels”] for any promotional or marketing purpose (“Permitted Purposes”). Provided that, Tide will endeavour to portray me and my business in a positive light. For the avoidance of doubt, Tide has no obligation to use the Submission as part of its promotional materials or marketing activities. Once submitted to Tide, I also waive any right to inspect, modify, approve, or disapprove the layout, presentation or any other aspect of my Submission prior to use.

2. I acknowledge that the publicity of my name or business by Tide constitutes sufficient consideration for the rights I grant herein. I acknowledge that I’m not entitled to any other consideration and agree not to make any monetary or other claim against Tide for the use of my Submission.

3. In granting my Submission I represent that I am the owner or an authorised representative of my business and that I have the power and authority to grant this consent and release. I agree that Tide will have complete ownership of any promotional materials or finished product created by Tide based on or containing my Submission, any related materials and derivative works (“Tide Material”). I further agree to waive any ownership rights I may have, including but not limited to copyright, in any Tide Material.

4. I release Tide and those acting pursuant to its authority from liability for any violation of any personal or proprietary right I may have in connection with the Submission.

5. I acknowledge that my Submission may contain my personal data and that through this document I consent to Tide processing and sharing my personal data for the Permitted Purposes by publishing my personal data via the Permitted Channels. I also understand that I am entitled to access this personal data held by Tide at any time and, where appropriate, make requests for the correction or deletion of my personal data by reaching out to Tide at dpo@tide.co. I understand that I can find more information about Tide’s personal data processing practices and my rights at https://www.tide.co/en-in/privacy/.

6. I further acknowledge that I have the right to withdraw my consent to Tide using and processing copies of my personal data contained in my submission by reaching out to Tide at dpo@tide.co. I understand the withdrawal of my consent and/or a request for deletion may entail an obligation to return any remuneration, benefits, gifts or similar received by Tide in exchange of my Submission and will not affect the lawfulness of any prior processing of my personal data by Tide or any third-parties up to the point of my withdrawal. I also understand that Tide is not liable for any secondary processing of my personal data by third-parties who may have downloaded, copied or otherwise reproduced my personal data after Tide has published it via the Permitted Channels for the Permitted Purposes.

I have read and fully understand the terms of this release, which are governed by the laws of India. I acknowledge and agree that any claims or disputes arising out of, or in connection with this release, must only be brought in the courts of New Delhi, India.
