Tide Smart Plan Benefits Terms and Conditions

Introduction

These Terms and Conditions ("Terms") govern the benefits on your Tide Smart Plan (referred to as a "Smart Plan") provided by Tide Platform Private Limited ("Company" or "we" or "us" or "our"). By purchasing the Smart Plan, you agree to be bound by these Terms. Please read them carefully.

These Terms must be read with, and form part of the Tide Membership Terms and Conditions (including the Paid Plans Terms and Conditions referenced there), and the Tide Expense Cards Terms and Conditions.

Subscription Fee

The subscription fee for the Smart Plan will be displayed on the Tide app. We may waive this Fee as part of a free trial in our sole discretion. Upon expiry of the free trial, you will be charged the applicable subscription Fee.

Plan Duration

Your Smart Plan will come into effect on the date you subscribe to it and will remain valid until the last date of the month in which you subscribe to it ("Plan Duration"). Once subscribed, your Smart Plan will auto-renew for successive Plan Durations until you cancel the subscription. 

#However, for certain benefits such as cashback on eligible spends and cashback on bank transfers, all transactions you make in the calendar month of subscription ("Subscription Month") will be considered towards cashback. For example, if you subscribe to the Smart Plan on the 20th of a month, all transactions you make in such a calendar month (whether before or after the 20th) will be considered towards cashback.

Plan Benefits

The Smart Plan offers the following benefits:

  • Black coloured Tide Expense Card

  • All benefits available on the Lite Plan

  • Cashback of up to INR 9,000 on eligible spends made using your Tide Expense Card (see table A below for complete details)

  • Amazing discounts on your favourite food delivery, grocery and travel apps and get amazing discounts, subject to the T&Cs of each such partner brand offer.

  • Free ATM withdrawals using the Tide Expense Card. Any charges applicable for ATM withdrawals will be refunded to your PPI

  • Priority in-app chat support

  • Callback support

  • Cashback on transferring funds from your PPI (linked to your Tide Expense Card) to your verified bank account

- If the amount transferred cumulatively reaches INR 100,000 – INR 1500

- If the amount transferred cumulatively reaches INR 200,000 – INR 3500

  • A reduced fee of flat 1.25% when you transfer funds from your PPI (linked to your Tide Expense Card) to your verified bank account.

  • Business helpline: Get information about business registrations and requirements; callback from an expert within 24 hours (other than on Sunday)*. Each member shall be eligible for maximum 5 callbacks per month.

Specific Category Exclusions (in addition to the general exclusions set out below) - transactions in these categories will not count towards eligibility for cashback

Cumulative spends of up to INR 49,999 on your Tide Expense Card during the Subscription Month

1.5% of the transaction amount, up to a maximum of INR 750.

Transactions made on the Mobikwik website and mobile application 

Transactions directly or indirectly made towards payment for the following:

Education: Universities/colleges (8220), Elementary/secondary schools (8211), Correspondence schools (8241).

Travel & Transportation: Passenger railways (4112), Local/suburban commuter transport (4111).

Government & Public Services: Government/fire departments (9399), Tax payments (9311).

Other: Insurance (6300), Charitable/social services (8398), Agricultural inputs (0825).

Cumulative spends greater than INR 50,000, and up to INR 2,00,000 on your Tide Expense Card during the Subscription Month

1.5% of the transaction amount, up to a maximum of INR 3000.

Transactions made on the Mobikwik website and mobile application 

Transactions directly or indirectly made towards payment for the following:

Grocery & Food: Grocery stores, supermarkets (5411), miscellaneous food stores, specialty markets, and convenience stores (5499).

Contractors & Construction: General contractors (residential buildings - 1520), electrical contractors (1731), special trade contractors (1799), concrete work (1771), carpentry (1750), AC, heating, or plumbing contractors (sales & installation - 1711), roofing, sheet metal work, or siding contractors (1761).

Utilities & Fuel: Electric, gas, sanitary, telephone, or water utilities (4900), gas/service stations with or without ancillary services (5541), automated fuel dispensers (5542), fuel dealers (fuel, oil, wood, coal, liquor - 5983).

Education: Business or secretarial schools (8244), schools and educational services (NEC - 8299), vocational or trade schools (8249), universities, colleges, senior colleges or professional schools (8220), elementary or secondary schools (8211), correspondence schools (8241).

Financial & Insurance: Direct marketing insurance services (5960), security brokers/dealers (6211), financial institutions (merchandise & services - 6012), insurance sales and underwriting (6300).

Government & Public Services: Alimony, child support, or court costs (9211), government services (NEC) or fire departments (9399), tax payments (9311), charitable or social services organizations (8398).

Transportation: Passenger railways (4112), local/suburban commuter passenger transportation, including ferries or water transportation (4111).

Other Services: Telecommunications services (including local/long-distance credit & fax - 4814), real estate agents and managers, rentals (6513), agricultural inputs (0825).

Cumulative spends greater than INR 2,00,000, and up to INR 6,00,000 on your Tide Expense Card during the Subscription Month

1.5% of the transaction amount, up to a maximum of INR 9,000.

Cumulatively spend at least Ten Lakh Rupees (INR 10,00,000) during the Subscription Month using your Tide Expense Card and be the top spender during the Subscription Month out of all participating Tide members.

Please note that subscribers of some of our other subscriptions (like the Rewards Pass Plus) are also entitled to participate in the top spender category. Accordingly, the top spender will be picked out of all participating members.

Transactions directly or indirectly made towards payment for the following:

Educational Institutions: Universities, colleges, senior colleges, professional schools (8220), elementary or secondary schools (8211), and correspondence schools (8241).

Government & Public Services: Insurance sales and underwriting (6300), government services (NEC) or fire departments (9399), and tax payments (9311).

Transportation: Passenger railways (4112) and local/suburban commuter passenger transportation, including ferries or water transportation (4111).

Non-Profit & Social Services: Charitable or social services organizations (8398).

Agricultural: Agricultural inputs (0825).

  • We retain the right to periodically update the list of excluded categories.

  • Reliance on Spend Tracker: The spend tracker provided within our app is for illustrative purposes only and may not accurately reflect the final eligibility of transactions towards cashback. While it tracks your overall spending, it may include transactions that are ultimately ineligible due to specific exclusions (such as merchant category codes, transaction types, or use of the Mobikwik platform) as detailed throughout these Terms. The final determination of your eligibility and cashback will be based solely on the official criteria and exclusions set forth in these Terms, and not on the figures displayed by the in-app spend tracker.

  • We determine cashback eligibility based on the Merchant Category Code (MCC). We do not control or have the ability to change a merchant's MCC. Consequently, a transaction may appear eligible for a cashback based on the product or service sold, but it may not be eligible due to the MCC assigned to the merchant.

  • Only genuine transactions will count towards eligibility for cashback under these Plan Benefits. A transaction will not count towards the eligibility for cashback if: (a) you cancel or reverse the transaction; (b) the transaction is invalidated or refunded or fails to go through; (c) the merchant or you dispute the transaction; (d) the transaction is made to load/fund your PPI associated with the Tide Expense Card; (e) the transaction is not made during the Subscription Month; (g) the transaction is a cash withdrawal from an ATM; (h) the transaction is not valid or appears to be suspicious or fraudulent or done with an intent to abuse the process or for wrongful gain to any member or wrongful loss to Tide; or (i) the transaction is made towards a purchase of prohibited goods or services.

  • In case of a tie (where two or more members spend the same amount) for the top spender category, all eligible members will be required to answer qualifying skill-based questions correctly within the given time period using the link we share. The member first in time to answer the questions correctly will be eligible to claim the reward. For example, if 10 members have spent the same amounts during the Subscription Month, the member who answers the qualifying skill-based question first in time will be eligible to claim the reward. The timestamps of responses will be used to determine the time of answering the qualifying question. If you do not respond within the given time period, or answer any question incorrectly, you will not be eligible to claim the reward.

  • We reserve the right to modify or withdraw the Smart Plan benefits or these Terms, at any time. Rest assured, such changes won’t apply to Smart Plan benefits already accrued before the changes or withdrawal came into effect.

  • Cashback terms on our paid plans may change month on month and we request you to carefully read the cashback terms for the month in which you are transacting.

  • Cashback will be credited in the PPI associated with your Tide Expense Card, within 60 business days from the last date of each Plan Duration.

Other Terms and Conditions

  • These Terms are to be read together with the Tide Membership Terms and Conditions and Tide Expense Cards Terms and Conditions. Those terms are incorporated here by reference and form an integral part of these Terms. Members who are not compliant with those terms will be disqualified from receiving these Smart Plan benefits. With respect to these Plan Benefits, these Terms will prevail in case of any conflict between these Terms and any other terms & conditions of Tide.

  • We consider the date on which money is deducted from your PPI (linked with your Tide Expense Card) as the date of the transaction.

  • Any member who violates these Terms will be disqualified from receiving cashback. In particular, any member who is found: (a) tampering with the operation of a Plan benefit or cashback; or (b) acting in an unsportsmanlike or disruptive manner or with intent to abuse, cause wrongful loss, defraud, threaten or harass any person, will be disqualified from receiving cashback. 

  • These Plan Benefits cannot be combined with any other offer or promotion run by Tide, or with benefits under any other subscription we offer. Further, certain benefits (like cashback and discounts) under the Smart Plan are only offered once per Plan Duration.

  • If we find that cashback have been delivered to you incorrectly, we reserve the right to cancel or set off such erroneously delivered cashback against any sums we owe you, subject to applicable law. We also reserve the right to withhold or forfeit any cashback we believe have been earned fraudulently.

  • You acknowledge and agree that your purchase of the Smart Plan through the Tide Platform is for commercial purposes related to your business. Any disputes between you and Tide related to the Smart Plan will be governed by these Terms, the Tide Membership Terms and Conditions, and general contract law. You agree to not hold us responsible for any delays in delivery of cashback caused due to events beyond our reasonable control.

  • Taxes: You (and NOT we) are responsible for all taxes, duties, levies or other statutory dues and charges payable in connection with any cashback you win under an offer.

  • If we find that cashback has been delivered to you incorrectly, we reserve the right to cancel or set off such erroneously delivered cashback against any sums we owe you, subject to applicable law. We also reserve the right to withhold or forfeit any cashback we believe have been earned fraudulently.

  • *We have a financial arrangement with experts who provide a business helpline to you. They are independent from us and are not an employee, agent, or representative of Tide. They will provide you with impartial and confidential information, limited to general support only and as specified to you by them over the telephone. In general, this will be oral advice, as is reasonably possible to provide on a call. The business helpline cannot help you with representation, initiation of any filings, proceedings or other similar action, document review, or written opinions. We make no representation regarding the quality or accuracy of the information provided and accept no responsibility for the services provided to you by such experts. No claim or action will lie against Tide should you choose to act on information you receive through the business helpline. Your reliance on the advice is at your sole risk.

Queries and Complaints

For any queries relating to Smart Plans, you can message us in-app via the member support function.

Our decision as to the benefits, cashback, rewards and any associated computation will be final and binding. For questions about the Smart Plan benefits, please contact us at indiasupport@tide.co  within 90 days from the date the rewards/cashback is announced, failing which no further queries will be entertained regarding the Smart Plan benefits.
