Tide Paid Plan Terms and Conditions

  1. Introduction

    1.1- The Tide cashback membership plan (referred to as a “Paid Plan”) is provided to you by Tide Platform Private Limited (“Tide” or “we”, “us”, “our”), a company with CIN U72900TG2020FTC139019 and having its registered office at Level 13, Plot No. 19, Software Unit Layout, Madhapur Hyderabad, Telangana – 50008″
    1.2- The Paid Plan may be available to select Tide Members only. We reserve the right to offer the Paid Plan to select members at our sole discretion.
    1.3- These Paid Plan Terms and Conditions (“Subscription Terms”) should be read together with the Tide Membership Terms and Conditions (“Tide Membership Terms”) and the Tide Expense Cards Terms and Conditions (“Expense Card Terms”).
    1.4- Any capitalised terms used here but not defined will have the meanings given to them in the Tide Membership Terms. These Subscription Terms will prevail in case of any conflict with the Tide Membership Terms.
  2. How does it work?

    2.1- If you purchase the Paid Plan, you will be eligible to receive cashback when transacting through your Tide Expense Card as per the offer terms set out under Annexure A. We may roll out additional benefits for subscribers of Paid Plans from time to time. The benefits provided under the Paid Plan are for you alone and such benefits may not be transferred or assigned to any person.
    2.2- The benefits available under a Paid Plan will be provided until you have an active, valid Paid Plan. In case of cancellation or expiry of your Paid Plan, we will stop providing the benefits under the Paid Plan to you, until you renew it.
    2.3- All rewards accrued under the Paid Plan benefits will be subject to the applicable limits of the Prepaid Payment Instrument (“PPI”).
  3. Subscription Fees and Billing 

    3.1- Fees: The Paid Plan membership costs Five Hundred Rupees (INR 500) per month including applicable taxes. We may waive this fee at our sole discretion.
    3.2- Billing for Paid Plan: Fee for the Paid Plan will be charged monthly in arrears. A Paid Plan will remain valid for the duration of the entire calendar month in which it is purchased. For example, if a Paid Plan is purchased on the 10th of March, the Paid Plan will remain valid until the last day of March (31st) and all transactions made in the month of March (starting from the 1st of March) would be considered towards calculation of cashback for such month.
    3.3- Fee for Paid Plan will be set-off against the cashback due to you from us. For example, where you’re eligible to receive cashback worth INR 15,000 from us, INR 500 would be set-off towards the Paid Plan fee and the remaining INR 14,500 would be credited to you. You authorise us to set-off the Paid Plan fee against the cashback we owe you, as it becomes payable. Provided that, where there is not enough cashback available to set-off against the fee for Paid Plan, you will not be able to avail benefits of the Paid Plan and your Paid Plan will be cancelled. The Paid Plan Fee is non-refundable.
    3.4- Changes to fees and billing: From time to time, we may change the Paid Plan fees, the benefits available under it and billing terms. Such changes will be communicated to you by email, in-app, calls, WhatsApp or through our website.
    3.5- Renewals and Cancellations: Your Paid Plan will renew each month upon your confirmation. You can cancel your Paid Plan at any time by contacting Tide in-app support. There will be no pro-rata refund of fees in case of early cancellation. Your Paid Plan will remain active until the end of the calendar month in which you cancelled, and you will be charged fees in full for that month.

  4. Important Information

    4.1- These Subscription Terms will remain in place until terminated by you or us. You may terminate the Subscription Terms at any time by contacting Tide in-app support. The termination of the Subscription Terms will not automatically lead to the termination of the Tide Membership Terms, or any other additional products and services provided by Tide unless we inform you otherwise. But termination of the Tide Membership Terms will automatically terminate these Subscription Terms.
    4.2- We can change or terminate these Subscription Terms by giving you a reasonable prior notice. Any changes we make to these Subscription Terms will be made available to you by email, in-app, calls, WhatsApp or through our website. You should save and/or print a copy of these terms for future reference. However, we reserve the right to change these terms without giving you notice where:
    4.2.1- the change benefits you;
    4.2.2- we make a change to comply with law, regulation or related guidance and we’re not reasonably able to provide advance notice;
    4.2.3- we’re introducing new services or features relating to the Paid Plan or introducing new paid plans; or
    4.2.4- the changes are minor, or do not affect the quality of the service, or do not materially impact your rights under these terms.

    4.3- Unless you’ve informed us otherwise before any change takes place, we’ll assume that you’ve accepted the changes to these Subscription Terms. If you do tell us that you do not accept any change, your notice will be deemed to be your request to cancel your Paid Plan on the date upon which the changes are due to take effect (or any other date that you request in advance of the changes taking effect).
    4.4- If any term, condition, or provision of these Subscription Terms is found to be unlawful, invalid, void, or unenforceable for any reason, the validity and enforceability of the remaining terms, conditions and provisions will not in any way be affected or invalidated.
    4.5- If we don’t exercise the rights that we have against you straight away, we can still do so later.4.6- Indian law governs these Subscription Terms, and the parties agree to the exclusive jurisdiction of the courts of New Delhi to adjudicate any dispute arising out of or relating to these terms.

    For any queries relating to Paid Plan, you can message us in-app via the member support function.

    Annexure A
    Offer terms governing cashback on Paid Plan

    1. To be eligible to receive cashback, you must: (a) make valid transactions worth at least Two (2) Lakh Rupees on your Tide Expense Card during a calendar month and meet the transaction milestones specified below; and (b) make such transactions for personal use and not for business use.

    2.Cashback will be calculated on a monthly basis at the end of each calendar month depending on the transactions you have made in such month.


    3. You will receive an email from us informing you about your cashback. To receive cashback, we may require you to provide us any additional information. If you fail to provide such information, within five (5) business days from the date of our email, you will be deemed to have forfeited your chance to claim the cashback.

    4. If you meet the eligibility criteria and have followed the instructions in our email, you can receive cashback of up to INR 21,000 in a calendar month. Cashback will be credited in the PPI associated with your Tide Expense Card. We aim to make the cashback payment within thirty (30) working days from the last date of each calendar month.

    5. If cashback cannot be credited to your PPI for any reason, we reserve the right to offer you Amazon gift cards of amounts equal to the cashback you’re eligible for. Gift cards will be sent to your email ID registered with us. Note that it may take up to thirty (30) days after the completion of the calendar month for your gift card to arrive in your email. In case you receive the reward in the form of an Amazon gift card, please note that additional terms may apply to the redemption of the Amazon gift cards (including Amazon’s own terms). We advise you to review all information included with your Amazon gift card. If you avail of your Amazon gift card, Amazon will process your personal data (as a data fiduciary separate from us) in line with its privacy policy. You understand that we do not issue Amazon gift cards. Accordingly, we are not responsible for any issues relating to their use, redemption, limitations, or unavailability. We give no warranty of any kind nor accept any liability in connection with the Amazon gift cards distributed as part of the offer.

    6. Members who are not compliant with the Tide Membership Terms will be disqualified from this offer. We reserve the right to disqualify any member who is found: (a) to not meet the offer requirements; (b) tampering with the entry process or the operation of an offer; (c) acting in violation of these terms; or (d) acting in an unsportsmanlike or disruptive manner or with intent to abuse, cause wrongful loss, defraud, threaten or harass any person.

    7. This offer, the eligibility criteria, disqualification criteria, validity criteria for transactions, rewards and any other terms can be modified, withdrawn, or cancelled, in part or in full, at any time, in our sole discretion, with reasonable prior notice.

    8. This offer is only valid once per member and no member will be eligible to participate in this offer twice. This offer cannot be used in conjunction with any other Tide offer or promotion.

    9. By participating in this offer, you give us and our affiliates permission to use your name, likeness, image, and appearance (collectively “Image”), as collected or received in relation to the offer, for our communications, promotions, events, or contests. You acknowledge that the cashback you receive is adequate consideration for such use of your Image. You release us, our affiliates, and their agents and assigns from any claims arising out of, or relating to such use of your Image.

    10. We consider the date on which money is deducted from your PPI (linked with your Tide Expense Card) as the date of the transaction.

    11. If your Tide Expense Card is cancelled or withdrawn, or if the PPI associated with your Tide Expense Card is terminated or suspended, any cashback earned under this offer (which is yet to be delivered) will be deemed forfeited.

    12. Only genuine transactions will count towards eligibility for this offer. A transaction will not count towards the eligibility for this offer if: (a) you cancel or reverse the transaction; (b) the transaction is invalidated or refunded or fails to go through; (c) the merchant or you dispute the transaction; (d) the transaction is made to load/fund your PPI associated with the Tide Expense Card; (e) the transaction is not made during the offer period; (g) the transaction is a cash withdrawal from an ATM; (h) the transaction is not valid or appears to be suspicious or fraudulent or done with an intent to abuse the process or for wrongful gain to any member or wrongful loss to Tide; (i) the transaction is made towards a purchase of prohibited goods or services; or (j) the transaction is directly or indirectly made towards payment of rent, utilities, bill payments, fuel or education fee. This list is non-exhaustive and may be subject to change from time to time. Merchants or the merchant banks get a specific code based on what they sell or the services they provide. This code is called a Merchant Category Code (MCC). We use the MCC to determine if you can earn cashback on a transaction. We do not control what type of MCC a merchant gets and are not able to change this code. This means that in some cases, a merchant might sell something that seems eligible for cashback, but because of the MCC, the transaction isn’t eligible.

    13. If we find that cashback has been delivered to you incorrectly, we reserve the right to cancel or set off such erroneously delivered cashback against any sums we owe you, subject to applicable law. We also reserve the right to withhold or forfeit any cashback we believe have been earned fraudulently.

    14. This offer is being made on a “best effort” basis and participation in this offer is voluntary. By participating in this offer, you agree to release from liability, and hold harmless us, and any of our affiliates, employees or agents representing or related to us and our services/products. This release is for all liability arising out of, or in connection with this offer, even if caused or contributed to by our negligence.

    15. We are not responsible for: (a) any error in the operation of the offer, including for technical, network, telephone, computer, hardware or software malfunctions of any kind; (b) any inaccurate transmission of, or failure to receive any information on account of technical problems or traffic congestion on the Internet or at any website; (c) any lost, misdirected, late, incomplete, unintelligible or inaccurate participation information, whether caused by you or by any of the equipment or program associated with or utilized in the offer, or by any technical or human error while processing the offer; (d) any printing or typographical errors in any materials associated with the offer; or (e) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the offer.

    16. Indian law governs this offer. The parties agree to the exclusive jurisdiction of the courts of New Delhi to adjudicate any dispute arising out of or relating to these offer terms.

    17. You (and NOT we) are responsible for all taxes, duties, levies or other statutory dues and charges payable in connection with any cashback you receive.

    18. Our decision as to the cashback and any associated computation will be final and binding. For any disputes about the cashback, you must reach out to us at indiasupport@tide.co within thirty (30) days from the date you’re informed about the cashback you’ve earned under the offer.
