FATCA

My company and all its controlling persons are tax resident only in the UK - do I still need to certify? Will you share my details with other tax authorities?

Yes, you must still complete a self-certification. We are required to collect a FATCA/CRS self-certification from all members to determine the correct status.

  • If your company and all controlling persons are UK only, your account is generally not reportable under CRS or FATCA.

  • Under CRS, we report accounts of non-UK tax residents to HMRC, which may then exchange the data with the relevant foreign tax authority. UK only accounts are not reported for CRS exchange.

  • Under FATCA, only U.S. reportable accounts are reported – for example, if an entity or any controlling person is a U.S. tax resident or citizen. If everyone is a UK resident or citizen only, and there are no U.S. connections, the account is not FATCA-reportable.

We may still retain your information to meet our legal obligations and, where required, provide information to HMRC. Routine cross-border sharing does not occur for UK-only statuses.

Keep us updated: If your circumstances change – for example any indication of tax residency outside the UK for the company or a controlling person – your account may become reportable. Please tell us as soon as possible, and no later than 90 days after the change.

Periodic checks: We may ask you to reconfirm or update your FATCA/CRS details from time to time as part of our regular reviews.
